I spoke with my credit card company and after explaining the whole situation, they put the whole charge that I paid the first shop in a dispute status. Now once I get the final bill he will be obligated to refund some money so it won't be quite as painful to pay again.......

If it wasn't due to anything you did, shouldn't they be responsible for the entire bill and not just a portion ?
If they did it right in the first place, there would no charges/work later unless you misused it intentionally.

Yes, I suppose the shop should be liable, but in the interest of fairness, I feel they should get something because they did pull the tranny and put it back in.

I agree Tom, if they dropped it and worked on it, but consider this, if they did it right, they'd be setting pretty and with a profit. But since they did not, they cause 'you', their customer, to spend more to repair what they should have done correctly in the 1st place.

So I'm sorry, they should pay the full bill, of take it back at their expense or send someone to fix what they screwed up. Once they accepted the job, worked on it and took your money, they became liable, unless you are willing to except the fault instead and release them from any portion / total liability.

Like I was told once, 'Are you the customer, or their friend ?'

Well, Jim, The way I see it is yes, they did the job and yes they screwed it up. I am not about to let them attempt another repair. Judging by the conversations I have had with the owner of the business we would wind up in court and since the court papers need to be filed and heard in the jurisdiction where the work was performed, I would need to travel over 2,000 miles. Depending on the judge I may get an additional $600 or I may get nothing. All in all it would cost me more to fight this fight than what I would get back in return. Therefore, I decided that it would be in everyone's best interest to settle and move on. Is it the best solution? No, not for me, but under the circumstances it is equitable.

I understand, but a reputable company would stand by their work.
Hope they don't do this to other out of state customers.

You would hope so, but apparently not the case with this guy. I have not found anyone else who claims grinding on the steels is an accepted procedure when repairing an auto transmission.

I spoke with the trans shop. The trans was ready to go last Thursday. The torque converter is still at Goerends. I was told they finally looked at it yesterday. They have only had it since Monday........ Gonna be THREE WEEKS this time....

That would be good to get it back. I am waiting for Goerends to get the converter shipped back. I dunno, but to me it seems as their customer service has gone to just shy of over a cliff. It is nothing like it used to be. They had my converter in their shop on Monday the 18th, finally began looking at it on Wednesday the 20th, and here it is eight days after they got it and I still have not seen it....... THREE WEEKS (and counting) my truck has been down this time. I am really getting pissed........
